Introduction of the usage agreement:

Our online store welcomes you and informs you that you will find below the Terms and Conditions governing your use of this store and all legal effects resulting from your use of the store’s services via the internet through this electronic platform. The use of this store by any person, whether as a consumer of a service or a product or otherwise, constitutes consent and acceptance of this agreement. The user confirms that they are legally qualified and competent to agree to all articles and provisions of this agreement. This agreement applies to all types of transactions between the store and the consumer.
This agreement becomes valid and effective immediately upon your approval and registration with the store, in accordance with the Kenya Information and Communications Act and applicable electronic transactions laws of Kenya.

Article one-introduction and definitions:

The above introduction is an integral part of this Agreement. The following terms shall have the meanings set out below:

  1. (Store): Refers to (Store Name) and includes all forms of the store on the internet, whether as a mobile application, website, or commercial platform.

  2. (Consumer): Any person who engages in e-commerce to obtain products or services provided by the store through its electronic platform.

  3. (Agreement): Refers to these Terms and Conditions governing the relationship between the store and the consumer.

Article two-legal capacity of the consumer:

  1. The consumer acknowledges that they have full legal capacity to deal with the store or that they are at least eighteen (18) years old.

  2. The consumer bears full responsibility for any violation of this article toward third parties.

Article three-the nature of the obligation:

  1. The store’s obligation is to provide the (service or product) to the consumer.

  2. The store may provide additional services, including after-sales services or related services, depending on the nature of the (service or product).

Article four-terms of use

  1. The consumer must use the store’s electronic platform in accordance with public morals and applicable laws and regulations in the Republic of Kenya.

  2. When purchasing any product or service, the consumer must not use it in violation of public morals or laws in the Republic of Kenya.

Article five-accounts and registration:

When registering as a user, you must provide accurate information and choose a confidential username and password. By doing so, you agree to the following:

  1. You are responsible for maintaining the confidentiality of your account information and password and must notify the store immediately of any unauthorized use.

  2. The store shall not be liable for any direct or indirect, material or moral loss resulting from disclosure of login information.

  3. You are solely responsible for all activities conducted through your account. Any use by third parties is deemed authorized by you.

  4. You must use the store seriously and honestly.

  5. You must provide accurate, complete, updated, and lawful information and update it when necessary.

  6. The store commits to maintaining confidentiality of personal data and contact details.

  7. The store reserves the right to suspend or terminate accounts providing false, inaccurate, illegal, or misleading information.

  8. Failure to comply with these terms may result in suspension or termination of access without prior notice.

Article seven-amendments to the usage agreement and fees:

  1. Invalidity of any provision does not affect the validity of the remaining provisions.

  2. This agreement may be amended from time to time and represents the full understanding between the consumer and the store.

  3. All fees are calculated in Kenyan Shillings (KES), and the consumer must pay all applicable fees.

 

Article six-electronic communications and official means of communication:

  1. Communication shall be conducted via the registered email address on the platform.

  2. Electronic communications shall have the same legal effect as written documents.

  3. The store may send notifications via public or targeted electronic messages.

 

Article eight-payment and payment services for stores:

  1. Payments can be made online through available payment methods provided by the store.

  2. Prices are set according to recognized market value.

  3. The store will issue invoices and receipts for all transactions.

  4. The store complies with generally accepted accounting standards.

Article Nine-intellectual property:

  1. All intellectual property rights belong exclusively to the store.

  2. The consumer must respect all intellectual property rights, including names, logos, and trademarks.

Article Ten-store liability:

  1. The store operates in accordance with applicable laws and regulations of the Republic of Kenya.

  2. The store is not liable for losses caused by consumer misuse or third parties such as shipping companies.

  3. All products or services are lawful and authorized under Kenyan law.

Article Eleven-restriction of access or membership:

The store may suspend or terminate access or membership at any time, without prior notice and without limitation.

Article Twelve-applicable law or regulation:

This agreement is governed by and interpreted in accordance with the laws and regulations in force in the Republic of Kenya, and is subject to the jurisdiction of Kenyan authorities.

Article thirteen-general provisions:

Invalidity of any provision does not affect the remaining provisions.

This agreement constitutes the entire contract between the store and the consumer, and both parties agree to the following:

  1. The English language is the governing language for interpretation and enforcement of this agreement.

  2. Prices may be amended from time to time.

  3. Promotional offers are temporary and may be modified or discontinued at any time.

  4. Both parties shall comply with applicable laws and regulations governing commercial transactions in Kenya.

  5. This agreement may only be terminated by a decision of store management.
